Embrained Beta Hardware Terms of Service

Welcome to the Embrained Beta Pilot. By purchasing, assembling, or using the Plexus robot beta hardware ("Hardware") or the Embrained Software Suite ("Software"), you ("User") agree to the following terms and conditions.



1\. Beta Pilot Acknowledgment

You acknowledge that the Hardware is an experimental beta prototype designed for testing visual navigation models. The Hardware and Software are provided "AS-IS" and "AS-AVAILABLE" without warranties of any kind. You understand that the Hardware may contain defects, software bugs, and incomplete features. Because the system relies on streaming local Wi-Fi telemetry for discrete control, latency may cause the Hardware to malfunction, stop unexpectedly, or behave unpredictably.



2\. Assumption of Risk \& Liability Waiver



a. Property Damage: You acknowledge that a mobile robot can bump into, scratch, or knock over items in your physical environment. Embrained, LLC is strictly not responsible for any property damage, interference, or injury caused by the operation of the Hardware. You agree to operate the Hardware only in safe, supervised, indoor environments.



b. Third-Party Power Sources \& Battery Risk: The Hardware requires lithium-ion batteries to operate, which are not included in the purchase. The User is solely responsible for sourcing, installing, charging, and maintaining appropriate third-party batteries according to Embrained's specifications. Embrained, LLC assumes no liability for any fire, property damage, or personal injury resulting from the use, misuse, charging, or failure of user-supplied batteries.



c. Limitation of Liability: To the maximum extent permitted by applicable law, Embrained, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.



3\. Intellectual Property \& Commercial Restriction

You are encouraged to modify, study, and enhance the open-source software and algorithmic models. However, the custom printed circuit boards (PCBs) and physical hardware design remain the exclusive intellectual property of Embrained, LLC. You may not reverse-engineer, duplicate, or manufacture the physical hardware for commercial resale.



4\. Data \& Privacy

During the Beta Pilot, the Software will stream video and telemetry strictly to your local network. Embrained, LLC's Software is designed to perform topological compression locally on your GPU. You are not required to upload raw camera imagery to our servers. Any decision to upload data (e.g., sharing latent representations or models on Discord) is voluntary. Please review our Privacy Policy for more details.



5\. Experimental Use

This Hardware is intended for educational, research, and experimental use. It is not intended for use in mission-critical applications, medical devices, or environments where failure could result in personal injury.



6\. Updates \& Flashing

You acknowledge that participating in the Beta Pilot may require you to flash new firmware to the ESP32 microcontroller, update Python dependencies, or manually modify configuration files. Embrained, LLC will provide instructions, but you are responsible for maintaining the Software on your own PC.



7\. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.



By proceeding with your purchase of the Plexus Beta unit, you accept these terms.
